These terms (the “Terms”) govern your use of the Forest Notification and Timber
Volume Tracking System website ( “NTVTS”) operated by First Resource Management
Group Inc. (“FRMG”) or its subsidiaries. If you access and use the NTVTS, you
accept and agree to be bound by and comply with these Terms.
The Terms also apply when you use a downloadable application or other
technology to access any features, functionality, content and/or information
that is made available or provided on the NTVTS.
All products and services of First Resource Management Group Inc (FRMG) that
are described, made available or provided on the NTVTS may be changed or
withdrawn at any time without notice and are subject to the terms and
conditions of the applicable agreements governing their use in force at the
time of the provision of the product or service.
The information, material and content provided in the pages of the NTVTS
(Information), is believed to be reliable when posted, but there is no
guarantee that it is accurate, complete or current at all times. Without
limiting the generality of the foregoing, the Information may include
inaccurate data, technical inaccuracies or typographical errors, and FRMG and its
officers, directors, employees have no obligation to update the Information.
FRMG and its officers, directors and employees specifically disclaim all
warranties, expressed or implied, with respect to the use of this material or
any results with respect thereto. The posted material may not reflect the most
current developments and may also contain errors or omissions, for which FRMG
and its employees disclaim all liability.
The Information or the NTVTS may be changed, withdrawn or terminated at any
time without notice.
Changes may be made to the Terms at any time without notice by updating this
posting. You agree to review the Terms regularly, and your continued access or
use of the NTVTS will mean that you agree to any changes.
FRMG and its officers, directors and employees are not responsible and will not
be liable to you or anyone else, for any damages whatsoever and howsoever
caused (including direct, indirect, incidental, special, consequential,
exemplary or punitive damages) arising out of or in connection with the NTVTS or
the Information, or your ability on inability to access or use the NTVTS or the
Information, or any action or decision made by you in reliance on the NTVTS or
the Information, or any errors in or omissions from the NTVTS or the
Information, or any unauthorized use or reproduction of the NTVTS or the
Information, even if FRMG has been advised of the possibility of these damages.
Trademarks, Copyrights and Intellectual Property
The software that runs the NTVTS is owned by FRMG and is protected by
copyright, trademark and other proprietary rights. Some data contained within
this web site is public domain or owned by the Ontario Ministry of Natural
Resources. Nothing on the NTVTS shall be construed as conferring any licence of
any intellectual property rights, whether by estoppel, implication or
otherwise. The Information is for your personal use, provided such use includes
a reference to the respective copyright and/or trademark notice or attribution
as denoted on the pages copied. The Information may not otherwise be copied,
displayed, distributed, downloaded, licensed, modified, published, reposted,
reproduced, reused, sold, transmitted, used to create a derivative work or
otherwise used for public or commercial purposes without the express written
permission of FRMG. The Information is protected under the copyright laws of Canada
and other countries. Any unauthorized downloading, re-transmission, or other
copying or modification of trademarks and/or the contents of the NTVTS may be a
violation of federal or other law that may apply to trademarks and/or
copyrights, and such actions could be subject the copier to legal action.
Information Provided By You
You agree that any information or materials that you provide to FRMG through
any of its Websites shall become the sole property of FRMG, and may be used
freely by FRMG.
The material on the NTVTS is covered by the provisions of the Copyright Act, by
Canadian laws, policies, regulations and international agreements. Such
provisions serve to identify the information source and, in specific instances,
to prohibit reproduction of materials without written permission.
Reproduction of multiple copies of materials on the NTVTS, in whole or in part,
for the purposes of commercial redistribution is prohibited except with written
permission from FRMG. To obtain permission to reproduce materials on the NTVTS for
commercial purposes, please contact FRMG.
Some of the materials, data and graphical elements found on the NTVTS are
subject to copyrights held by other organizations. In such cases, some
restrictions on the reproduction of materials or graphical elements may apply
and it may be necessary to seek permission from the rights holder prior to
reproducing the material.
No personal information is required to use the NTVTS other than your contact
information including your name and email addresses. If you choose to submit
personal or organizational information via the NTVTS FRMG will treat your
contact information as confidential and will not share it with any third
parties for any reason without your written consent.
Any unprotected email or other communication over the Internet is, as with
communication via other mediums (e.g. cellular phones, post office mail), not
secure or confidential, subject to possible interception or loss, and possible
alteration. You should not send any confidential, proprietary or sensitive
information via these media. FRMG is not responsible for and will not be liable
to you or anyone else for any damages in connection with an email or text message
sent by you to FRMG, or an email or text message sent by FRMG to you.
No endorsement or approval of any third party or its advice, opinions,
information, products or services is expressed or implied by any Information.
External Service Providers
In order to effectively operate the NTVTS, FRMG occasionally uses external
service providers. Such service providers are bound by a contract with FRMG to
treat any personal information they may receive in a manner that is consistent
with the provisions of the Privacy Act.
